Are all accidents no win no fee accidents? I do not think so. Even the world’s most powerful legal firm will not fight a lost battle. Why should a company or an individual compensate a suicidal stunt man? No win no fee accident claims will be a means to reward foolishness and careless if all accidents are considered as no win fee accident.
According to world Health Organization, over a million died as a result road accidents in the 1998. It has been estimated that globally, 1.2 million people are killed in road crashes each year and 50 million are injured. These figures could increase by large margin over the next two decades. How many of these accident victims can say that they did not in anyway put themselves in arms way?
Occupational accident is the nightmare that keeps most industrialists on their toes. Fatality can warrant the shutting down of a plant for some time, making to the company to loose millions of dollars. A construction sites could also close down as a result of an accident.
When an explosion occurs in a plant or on a site, depending on its magnitude, most activities are truncated. Industrial accidents could be as a result of the companies’ negligence or one man’s carelessness, but when they occur a lot of lives could be at stalk.
Companies have no choice but to work out some form of compensations, this is what industrialist dread. Such accident does not only kill and cause physical and health problems, they also destroys materials used for construction or production and impact on the environment.
It is sometimes difficult to work out compensation for people who are far from the immediate environment where accidents occur. However, most industrial accidents are a considered as no win no fee accidents.
Notwithstanding, these industries have enough money to employ the services of the most brilliant and eloquent lawyers to represent them, making it hard for victim to fight for their due compensations. Hence, one must have a very good lawyer to represent him or her. Sometimes, big law firm take challenge to boost their public relations.
It is surprising that despite huge noise made by no win no fee accidents claim law firms in the UK, only 31 per cent of accident victims actually claim their compensation using legal processes. Ignorance and timidity could be the reason why many are not legally fighting for their compensation. Perhaps, some do not think theirs could be characterized as no win no fee accidents. Settlement outside the court could be very inadequate.
